Arcwood Environmental™, LLC and its affiliates and subsidiaries (“Arcwood,” “we,” “us,” “our”) are committed to protecting the privacy of your information.

The following Privacy Policy (“Policy”) sets forth our policies and practices regarding the collection, use, and disclosure of the information we receive when you interact with through our online services.

Effective Date

This Privacy Policy is effective as of 12/18/2025.

This Policy applies to information we collect:

  • On this website (https://arcwoodenviro.com/) (“Website”) and other Arcwood websites which link to this Policy (each collectively a “Site”);
  • Through your use of our customer, supplier, and partner collaboration and data sharing portals, including, but not limited to, the Environmental Information System (EIS), and the Arcwood Storefront and other Internet or email-based services, registrations and surveys (each a “Portal”); or
  • In email, text, and other electronic messages between you and our Sites or Portals.

This Policy does not apply to information we collect:

  • Offline or through any other means, including on any website operated by any third party;
  • From any third party, including through any application or content (including advertising that may link to or be accessible from or through our Sites or Portals); or
  • Through your interaction with our careers page or applicant pool.

Please read this policy carefully. If you do not agree with our data handling policies or practices, please do not use our Sites or Portals. By accessing or using our Sites or Portals, you demonstrate your agreement with this Policy.

We reserve the right to change this Policy from time to time (see Changes to Our Privacy Policy below). Your continued use of our Site and/or Portals after we make any changes to this Policy will be deemed as acceptance of those changes, so please review this Policy regularly for updates.

Information We May Collect

We may collect the following types of information from Site and Portal users:

  • Identifiers: first and last name, mailing address, email address phone number, and company name.
  • Contact Information: mailing address, email address, and phone number
  • Financial Information: credit card or debit card information necessary to process online purchases and otherwise facilitating e-commerce.
  • Location Information: zip code
  • Device and Usage Information: We may collect information about the device you use to access our Site or Portals (“Equipment”), your use of our website or Portals, including links and locations accessed and downloads. We may also collect location information (if provided) and information about your operating system, browser, IP and MAC addresses, device identifiers and security status.
  • Other Information: We collect feedback you provide to us, answers to surveys and questionnaires, feedback about our services that you post on our social media accounts, and other information that you may provide to us in the free-text fields available on our Sites and Portals. Therefore, please do not include any information in free-text fields that you wish to keep private.

Please note that we have collected the above categories of personal information over the twelve (12) months preceding the effective date of this Policy.

How We May Collect Information

We may collect information from and about you in the following ways:

  • You provide it to us. You may give us information about you by completing forms or by communicating with us by email or otherwise through our Site or Portals. This includes information you provide when you complete the ‘Contact Us’ form on our website, register for an account, subscribe a communication provided through the Site or Portals, participate in an online event, post a review, or when you otherwise contact us through our website or Portals.
  • Automatically, using technology from our websites, applications, emails, and your Equipment. As you interact with our Site or Portals, we may automatically collect Device and Usage Information about your Equipment and your browsing actions and patterns. We collect this information by using cookies, server logs, web beacons, and other similar technologies. The Cookies and Automatic Data Collection Technologies section below contains more information about this activity and options to control or opt-out of certain data collection or uses. You can instruct your browser to block the acceptance of cookies or to provide you with a warning prompt before you accept cookies from the Portal(s). If you reject cookies, the functionality of the Portal(s) or our Site may be limited.
  • From others. We may receive information about you from third parties including, for example, our affiliated companies, business partners, subcontractors, analytics providers, service providers, and online providers such as Twitter, Facebook, and Google Analytics.

Please note that we have collected personal information using the collection mechanisms listed above over the twelve (12) months preceding the effective date of this Policy.

Cookies and Automatic Data Collection Technologies

We may use automatic data collection technologies to distinguish you from other website users. This helps us deliver a better and more personalized service when you browse our website and Portals. It also allows us to improve our websites and Portals by enabling us to:

How We May Use Your Information

We may use your information to conduct our business operations, including for the following purposes:

  • Provision of Services.

We may use and disclose your Personal and Usage Information to support the delivery of our services. For example, we may share our your information with your business affiliates, contractors, customers, or other entities as requested and designated by you. We may also make such information accessible to third-party service providers that assist us with managing our daily business operations, such as our supply chain vendors that provide disposal, transportation, and recycling support.

We also may share your information with third-party service providers that assist Arcwood with hosting and maintaining the Portals, processing online payments and otherwise facilitating e-commerce, and marketing our services. For example, we may use third parties such as Salesforce, Hubspot, and Google for these purposes. Please be aware that these third parties’ use of your information will be subject to their privacy policies or other terms, as applicable.

  • Contacting You.

We may use your information to directly contact you in response to your inquiries; inform you about Arcwood’s publications, products, and services; and email you newsletters, reports, and notifications to which you subscribe. We may also use your information to communicate with your company’s Arcwood user account administrator regarding your account and our services.

  • Improving our Services.

We may use your information to enhance our understanding of our users’ preferences and improve our services accordingly. Further, we may analyze Usage Information to better understand our users’ preferences with respect to the Portals’ contents and functionalities. We may also rely on Usage Information to provide you with tailored content and troubleshooting support.

  • Reporting to Regulators.

We may share your Personal or Usage Information with state or federal regulators, such as the Indiana Department of Environmental Management and the U.S. Environmental Protection Agency, when required to do so by law.

  • Law Enforcement, Safety, and Legal Processes.

We may share your Personal Information and/or Usage Information with law enforcement or other government officials if it relates to a criminal investigation or alleged criminal activity. We may also disclose your Personal Information and/or Usage Information if required or permitted to do so by law; for fraud protection and credit risk reduction purposes, or in the good-faith belief that such action is necessary to protect and defend the rights or property of Arcwood or the Portal users; and to act under urgent circumstances to protect the safety of Arcwood or its employees or a member of the public. We may also disclose your information to comply with a judicial proceeding, court order, subpoena, or legal process.

  • Sale or Acquisition of Assets.

If we become involved in a transaction involving the sale of our assets, such as a merger or acquisition, or if our services are transferred to another company, we may disclose and/or transfer your Personal Information and/or Usage Information as part of the transaction. If we are not the surviving entity in that transaction, the surviving entity may use your Personal Information and/or Usage Information pursuant to its own privacy policies and practices, which may differ from this Privacy Policy.

 

Disclosure of Information

We may share non-personal information without restriction.

We may disclose your personal information with the following:

  • Any member of our corporate group, which means our subsidiaries, affiliates, our ultimate holding company and its subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To an actual or prospective buyer or other successor in the event of merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, where one of the transferred assets is the personal information we hold.

Note: We will not share your mobile SMS opt-in data with third parties for use for their own purposes.

For the following purposes:

  • To fulfill the purpose for which you provide it.
  • With your consent.
  • For any other purpose as may be permitted by law or that we describe when you provide the information.
  • To comply with any court order, law, or legal process, including responding to any government or regulatory request.
  • To enforce our Website Terms and Conditions, this Privacy Policy, and other applicable policies or agreements with you.
  • To protect the rights, property, or safety of our business, employees, customers, or others. This includes exchanging information with other companies and organizations for the purposes of cybersecurity, fraud protection, and credit risk reduction.
  • To investigate suspected violations of any law, rule or regulation, or the terms or policies for our website.
  • To contact you about our own and third parties’ products and services that may be of interest to you. If you do not want us to use your information in this way, please adjust your user preferences in your account profile or opt-out as directed when you receive such an email from us. Please note that we have shared or sold personal information for the purposes above over the twelve (12) months preceding the effective date of this Privacy Policy.

Please note that any information you may post in a message section, chat, profile page, blog, or other part of our Site or Portals will be available to other users and the general public (and therefore not subject to this Privacy Policy), so please do not post personal information, confidential information, information not relating to you, or any other information you want to keep private.

Mobile opt-in and SMS consent is not shared with third parties or affiliates.

 

Your Rights and Choices

You may have the following rights related to your personal information:

  • the right to know what personal information we process about you;
  • the right to request certain personal information that we process about you be deleted;
  • the right to request we correct personal information we have about you which you believe is incorrect;
  • the right to have certain personal information we process about you returned to you in an accessible and useable format upon your request, if such request is technically feasible;
  • the right to opt-out of having your personal information processed in such a way that enables us to create a profile or for targeted advertising purposes.
  • the right to have your sensitive personal information processed only by us if you consent to such processing;
  • the right to not have your personal information processed by a technology which produces an automatic decision which results in a legal or similarly significant effect (in which we do not engage);
  • The right to opt-out of the sale of your personal; and
  • The right to opt-out of any profiling in furtherance of decisions that produce legal or similarly significant effects (in which we do not engage).

 

We have created mechanisms to provide you with the following control over your information:

  • Marketing. If you do not want us to use your email address or other contact information to promote or recommend our own products and services, or third parties’ products or services, you can opt-out by replying to any promotional email we have sent you or following the opt-out links on that message. This opt-out generally will not apply to information provided to us because of a product purchase, warranty registration, product service experience, or other transactions.
  • Accessing, Updating, and Deleting Your Information. If you have an account with us, you may have the ability to access your information and make updates to or delete your data. If not, you may contact us as set forth in the Contact Us section below to request access to, correction of, or deletion of personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or negatively affect the information’s accuracy.
  • Location Information. As noted, when you use our Site or Portals, we may automatically collect certain Equipment information. This includes the general or specific location of your Equipment through GPS, Bluetooth, or WiFi signals.
  • Cookies and Automatic Data Collection Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. However, if you disable or refuse cookies, please note that some parts of our sites may become inaccessible or not function properly. If you do not want Google Analytics to be used in your browser, Google Analytics provides an opt-out tool which can be found here. In some cases, you may be able to set your browser or email program to not download web beacons.

California Residents. If you are a California resident, you may have additional personal rights and choices with regard to your personal data. Please see Your California Privacy Rights for more information. California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our website that are California residents to request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes. At this time, we do not engage in this type of disclosure.

How we verify consumer requests

We may require that your identity be verified prior to processing a verifiable rights request. We may verify your identity by comparing the information we have about you against the information we receive when you submit your request. If we do not have enough information to verify your identity, we will reach out to you for additional information, consistent with applicable law. We may deny a rights request if we are unable to verify your identity.

Authorized Agents

permit you to designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. Even if you use an authorized agent to submit a request on your behalf, pursuant to applicable law we may still require that you verify your identity directly to us depending on the nature of the request and sensitivity of the information at issue.

If you are an authorized agent submitting a request on behalf of an individual, you must include a copy of the written, signed permission indicating that you are permitted to act on that person’s behalf.

APPEALING A DENIED REQUEST TO EXERCISE STATE PRIVACY RIGHTS

In some circumstances, we may deny your request to exercise one or more of the rights described above. If you disagree with our decision, you have the right to appeal our decision within 60 days of receipt of notice that your request has been denied. If you submit an appeal to a denied request more than 60 days after you have been notified of our decision to deny the request, we may deny your appeal. If you submit a timely appeal, we will respond within forty-five (45) days of our receipt of your appeal.

  • If you wish to appeal a decision, please clearly and plainly describe your basis of disagreement with our decision by responding through the same means by which we communicated our decision or by submitting your appeal using the information provided under Contact Us. We will review your appeal and either amend or uphold our decision. In either case, we will provide a written explanation of the reason for the decision. This decision will be final.

Security of Personal Information

We implement technical and organizational measures designed to safeguard the security of your personal information. Unfortunately, no data transmitted over or accessible through the Internet can be guaranteed to be 100% secure. As a result, while we attempt to protect all Personal Information, we cannot ensure or warrant that Personal Information will be completely secure.

Children’s Privacy

The Sites and Portals are not intended for use by a child under the age of 18. We do not knowingly collect any Personal Information from a child under the age of 18 through the Sites or the Portals.

 

Notice of Financial Incentives

 

We do not offer financial incentives or pricing discounts for providing your personal information or registering an account with us.

 

Retention of Information

We retain Personal Information only for as long as necessary for the purpose or purposes for which it was collected and in accordance with applicable law. The criteria used to determine our retention periods include:

  • The term during which we have a continuing relationship with you and provide services to you (for example, for as long as you have an account with us or continue to use the services).
  • Any legal obligation to which we are subject (for example, some laws require us to retain your transaction records for a certain period of time before deleting them).
  • Whether the information may be needed for other legal reasons, such as in connection with applicable statutes of limitation, litigation, or regulatory investigations).

Other Provisions

SMS Mobile Opt-In.

When you opt-in to receive SMS notifications from us, we may collect information such as your . This information is used solely for sending SMS . We do not share your SMS mobile opt-in data with outside parties for use for their own purposes. Mobile opt-in and SMS consent is not shared with third parties or affiliates. You can opt-out of receiving SMS notifications from us at any time by replying STOP to any SMS notification received from us. Reply HELP for help. Third-Party Links.

The Portals may contain links to websites not affiliated with us. Your use of an external website or any informational content found on an external website is subject to and governed by the privacy policies, terms, and conditions of that website. We do not endorse or make any representations or warranties concerning, and will not in any way be liable for, any informational content, products, services, software, or other materials available on an external website, even if one or more pages of the external website are framed within a page of our Portal(s). We are not responsible for the privacy practices of any external website.

Online Payments.

We use a third-party e-commerce vendor to collect and process your payments for any products and services you purchase using the Portals. Accordingly, Arcwood does not store your payment card information or financial account information. The information you provide when you make a purchase using the Portal will be subject to the vendor’s privacy policy, as well as any agreements between Arcwood and the vendor.

Accessing and Updating Information.

If you would like to access, update, delete, or modify Personal Information, you may do so through your Portal user account. You may reach us at the contact information listed below if you need assistance or would like to delete your user account. Modifying, updating, or deleting any information will not result in the modification, updating, or deletion of any such information that may reside in back-up or disaster-recovery storage.

Opting Out of email marketing communications.

If you would like to opt out of receiving email marketing communications from us, you may do so by changing your subscription settings through your Portal user account or contacting us at the contact information listed below.

Do Not Track.

Certain web browsers and other devices you may use to access the Portal may permit you to submit your preference that you do not wish to be “tracked” online. We do not currently commit to responding to these submissions, in part, because no common industry standard for “do not track” has been adopted by industry groups, technology companies, or regulators. We will make efforts to monitor developments around Do Not Track browser technology and the implementation of a standard.

Changes to our Privacy Policy

We will post any changes we may make to our Privacy Policy on this page. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for periodically visiting our website and this page to check for any changes. Any material changes to this policy will be preceded by notice as required by law.
